Online CPD Module

One of the first questions your clients will typically ask is whether they are likely to get bail when charged with an offence. This module will provide you with an update on the fundamentals of making bail applications and dealing with a variety common bail related issues.

This module will include:

• An overview of the Bail Act 2000 and the fundamental principles to be applied under this legislation
• A discussion on making and effectively advancing bail applications, including for electronically-monitored bail and bail in the High Court, and with regard to evidential considerations in operation
• A discussion on strategy as between making an application for bail simpliciter, electronically-monitored bail, and appealing a declinature at first instance.

Introduction

Bail is a priority issue for most clients who face being charged with a criminal offence. It demands that practitioners have a working knowledge of the key statutory provisions, and leading case law, applicable to bail in order to ensure that client needs are addressed as well as possible and in a time-sensitive manner.

This seminar is designed to update you on the fundamentals of making bail applications as well as dealing with a variety of common bail-related issues. It specifically considers advancing applications for electronically-monitored (EM) bail (compared with bail simpliciter) as well as bail in the High Court. It also addresses evidential matters for consideration as well as strategy for bail applications and appeals against declinature at first instance.

An exhaustive examination of every aspect of bail, including as provided for by the Bail Act 2000 (Act) is not possible in a seminar such as this. There are an abundance of situations and issues contemplated by different provisions of the Act. It must be the practitioner’s starting point. This seminar, instead, focuses on key aspects of the Act and leading authorities in order to provide guidance on bail issues practitioners may well face more regularly in our busy criminal courts. The aim is a practical one.
