A guilty plea or verdict is not the end of an offender’s opportunity to secure an acquittal. Under the Sentencing Act 2002, it is possible for the court to acquit an offender upon sentencing by imposing a discharge without conviction.
By outlining the relevant considerations at each step, this module will examine the test that must be satisfied before the court may exercise the discretion to discharge an offender without conviction.
