Introduction


For the purpose of this seminar, we have assumed that you have read our booklet “Hague Convention on Civil Aspects of Child Abduction” which we produced for New Zealand Law Society seminars held on that topic throughout the country in March 1995.

Eight years later, the Convention remains the subject of intense analysis by courts and commentators alike. This trend is likely to continue because more people than ever are travelling and living overseas. In addition, the number of New Zealanders with different cultural backgrounds is growing. When relationships break down, relocation by one of the partners to their country of origin is likely to occur and therefore it is vital all legal practitioners working in this area of law have a good understanding of how the Convention operates.

This chapter focuses on recent judicial developments affecting defences to applications for the return of children to their country of origin.
