Introduction

In order to understand the role of children’s views and the optimum outcomes for their care, family court professionals require sound knowledge of child development and the ability to apply that knowledge to the facts of a particular case.

The establishment of the Family Court was in recognition of a developing body of research highlighting the complexity of family issues arising from separation and the need for special expertise in counsel and the judiciary dealing with family cases.

At a time when society is questioning the role of the Family Court lawyers need to ask themselves “Are we really specialists working in a specialist jurisdiction?” and, if so, what part does the concept of families and child development play in decisions in Family Court cases?
