Introduction


Health and safety issues constitute major risks to many clients’ businesses and to their people. This paper will review recent WorkSafe prosecutions, and comment on the legal position regarding COVID-19 vaccinations of workers.
Health and safety law is governed in New Zealand by the Health and Safety at Work Act 2015 (HSWA) and is regulated by WorkSafe New Zealand. Under the HSWA, persons conducting a business or undertaking (PCBU) have a primary duty to ensure the health and safety of all workers at their workplace.
