Amendments to the Protection of Personal and Property Rights Act (PPPR Act) and the regulations are coming into effect. The review of Part 9 of the PPPR Act identified a number of legislative changes that were needed to improve the effectiveness of the enduring power of attorney (EPA) provisions and to encourage more people to set up EPAs.
This module will address the implications of these changes for practitioners. It will take you through new Forms 1 and 2, a detailed look at revocation of prior EPAs and what that means, how notice is given and what your duty is regarding consulting with the other EPA attorney. Also discussed will be the changes to medical certification and when an EPA ceases to have effect what the implications are for practitioners with joint authority, with several authority and what happens when you are the successor attorney.

In 2000 the Law Commission produced its report on abuse of enduring powers of attorney (EPAs) which included recommendations for legislative amendment to address issues of misuse, highhandedness, bullying and fraudulent behaviour by attorneys. The government response resulted in the 2007 amendments to the Act. Development of the Protection of Personal and Property Rights Amendment Bill was led by the Minister for Senior Citizens and the Office for Senior Citizens in the Ministry of Social Development by arrangement with the Minister of Justice, as the Ministry of Justice did not have the resources available to include the work on its programme.
