Caveats continue to be contentious. The time frames that apply to them can be tight. A good understanding of the right to caveat, and when the courts are likely to sustain a caveat, will assist you in advising your clients. What issues may arise in the registration and challenge of caveats? Are you up to date with the process of challenging and defending a caveat against dealings?

This webinar will consider caveats against dealings and deepen your understanding of who can caveat and under what circumstances. The process of challenging and defending caveats will be discussed with relevant case law. Finally, some practical issues which can arise will be considered. The implications of changes in the new Land Transfer Act 2017 will be integrated into the presentation.

Topics covered will include:

  • Those interests which will support a caveat (and those which will not)
  • Issues which arise when registering a caveat
  • The process of challenging and defending a caveat against dealings and the principles of the relevant case law (ie about whether the caveat will be sustained or lapse)
  • Practical issues and problems that can arise in this area of practice
  • The implications of the new Land Transfer Act 2017.

Learning objectives

You will:

  • Understand the scope of caveatable interests.
  • Be aware of the processes around registering, challenging, and defending caveats.
  • Recognise the principles the courts are applying in challenges to caveats and whether a caveat should be sustained or lapse.
