Many businesses are seeking advice about business interruption insurance. They wish to know where they stand generally. They are also looking to understand the insurer’s stance if the claim is not being paid. Business interruption insurance is a specialist area. It is presently the subject of a multi-party landmark proceeding in the United Kingdom, which the global insurance community is following with great interest. In this seminar, the presenters will discuss the legal issues arising out of business interruption insurance, with a focus on the COVID-19 pandemic and linked government action. They will look at the kinds of questions clients are asking and the issues that may be raised by insurers when a claim is made.

This module will include:

  • Explanation of the general structure of business interruption policies
  • Explanation of the operation of business interruption policies and claims; the kinds of issues that arise and how they are addressed
  • A discussion of COVID-19 business interruption issues
  • Analysis of a recent COVID-19 business interruption test case in the UK.

  • Advise business clients on business interruption claims generally.
  • Give specific advice to clients with respect to COVID-19 business interruption insurance issues.
