Working in the criminal law field continues to present an array of challenges and it is important that practitioners continue to remain abreast of developments. This seminar will include an examination of recent appellate cases and the implications for your clients on a practical level.

This seminar will include an update on the current criminal law, including:
  • Issues in sentencing
    - minimum periods of imprisonment
    - the effects of the Three Strikes regime
    - and a different approach to guilty plea discounts
  • The Court of Appeal’s approach to acquittal propensity
  • Developments in procedure: appeals; disclosure, representative charges.

Introduction

This paper will focus on three topics in the area of sentencing:

(a) discounts for guilty pleas;
(b) the application of the three strikes regime; and
(c) the imposition of minimum periods of imprisonment.

In all three areas, I suggest that we can see a willingness by the Courts to reduce prison sentences, or to adopt an approach that might avoid imprisonment altogether.

One might speculate that this is in part informed by knowledge of New Zealand’s rising imprisonment rates, or it may simply reflect the need to do justice in each individual case.
