For most separating couples, questions about the home, the mortgage, child care, insurances and division of furniture are relatively easily resolved with time, the right motivation and good advice. However, some cases drag on. During the sometimes long gap between separation and final settlement of property, much water may flow under the bridge.
In today’s financial climate, property values can still increase, but not always. Post-separation contributions can be unequal, so a strict 50/50 division is not fair. If couples share equally in gains, should they not also share equally in the losses? Following a separation, at what date should property values be “fixed”?
This Online CPD Module is based upon Professor Bill Atkin’s successful presentation at the recent 2013 PRA intensive. It will focus on events that occur after separation and the impact they can have on division of property. It will primarily examine “remedies” under ss 18B, 18C and 2G, including recent litigation.
