In many cases, expert evidence can be pivotal to the determination of key issues and counsel will invariably be confronted with the task of both working with and challenging the evidence of expert witnesses. This module will provide you with an overview of the law, practical guidance on dealing effectively with expert witnesses and incorporating expert evidence as part of a robust overall litigation strategy.

This module will include:

  • An outline of the requirements of ss 7, 8 and 25 of the Evidence Act and how this relates to expert evidence
  • Discussion on how the High Court Rules and the Code of Conduct of Expert Witnesses govern such evidence
  • The consequences of non-compliance with the Code: costs; disciplinary proceedings
  • Outline of the "basis" rule regarding underlying facts and assumptions
  • Discussion of due diligence in relation to experts: what can independent inquiries regarding the expert reveal?
  • How to identify that you might need the assistance of an expert
  • How to work out which expert to instruct
  • Ensuring the expert is able to address your specific issues
  • How to lead evidence from experts; how to cross examine and re-examine
  • Practical issues to consider when calling the expert in court.
