The trustee’s indemnity is considered a “core” feature of a trust as it is the beneficiaries who should bear the burden of trust liabilities. However, the trustee’s right of indemnity and property interest is very fragile and can be adversely affected in a number of ways. This webinar will include a helicopter view of the principles behind trustee indemnities, consider the thinking behind the s 86 Trusts Act 2019 reform for creditors’ claims, and provide an update of some of the key case law in this area.
