The Residential Tenancies Act 1986 (RTA) is the principal act governing the private rental market. The RTA regulates residential tenancies, established the Tenancy Tribunal and defines the Ministry of Business, Innovation and Employment’s regulatory roles and powers.
The RTA was reformed in 2018 and 2020 to improve tenants’ security of tenure, to modernise compliance and enforcement provisions including establishing the Health Homes Standards, removing the 90 day no-cause termination provisions for periodic tenancies, removing landlords’ ability to unilaterally give notice to end fixed term tenancies without specified grounds and amending tenants’ and landlords’ notice periods.
On 17 December 2024 the Residential Tenancies Amendment Act 2024 (2024 Act) was enacted. The 2024 Act sets out changes to the RTA including changes to the tenancy termination rules, bonds, and introducing new rules for keeping pets, which we will discuss in this paper.
