Introduction

Tendering in an e-dealing environment where there may be a litigation concern can be a challenge. In this relatively new area of law knowing which processes to adopt when there is an “unwilling purchaser” in a default environment is essential.

This webinar will look at key issues, as well as reflect on, the implications of emerging case law in this sphere. Practical strategies will be provided for use when addressing these issues, with particular focus given to:

  • Tendering settlement in the e-dealing environment arising out of Howe v Dempsey [2013] NZHC 229
  • Being ready, able and willing to settle in the absence of:
    • an e-dealing workspace
    • executing A&I forms
    • serving the settlement statement
  • Issuing a settlement statement when an A&I form has not been signed.
