This one-day interactive workshop will arm you with the knowledge required to face the challenges of PRA issues and trust claims in this ever-changing environment.

This workshop is focused on developing strategies for dealing with the Property (Relationships) Act 1976 (the PRA) issues, claims against trusts and protection of assets to withstand challenges. It will look at key principles and the developing case law pertaining to trusts and the PRA, including:
  • Still storming the castle – ss 182, 44, 44C and constructive trusts
  • Keeping the ramparts strong – ss 21 & 21A – current trends in contracting out agreements
  • Analysis of recent decisions.

Learning objectives

By the end of the workshop participants will be able to:

  • Assess the circumstances in which claims could be made and how to avoid them.
  • Develop strategies for dealing with the PRA and other claims against trusts.
  • Understand how trusts and property interact.
  • Identify the implications of recent cases in respect of trusts and PRA planning.

Who should attend

All practitioners who work with trust claims and relationship property will benefit from attending. Presenters will assume a general working knowledge of trusts and the PRA.

Format

This is a hands-on group workshop. The first half of the day will focus on the relevant legal principles, and the second half of the day will include a case study to run through the issues and apply the principles from the morning session to a practical scenario.

Cancellation and refund policy

You may cancel your registration eight working days in advance of an event, and you will receive a refund less a 25% administration fee. If you cancel less than eight working days in advance of the event, no refund is payable. If you are unable to attend, you may transfer your registration to another person. If you wish to do so you must advise CLE in writing of the change. NZLS CLE Ltd reserves the right to close registrations and cancel or reschedule an event as necessary. Where an event is cancelled by CLE, a full refund is payable.
