The admissibility of evidence is central to the administration of criminal justice. This seminar considers a range of aspects of the Evidence Act and provides practical guidance for courtroom practice.

The Evidence Act 2006 underpins all evidence adduced in courts at all levels. It is vital that criminal litigators remain up-to-date with its amendments and with current court direction on its use and application.

This module will not only cover legislative and case law updates, but also provide practical tips for improving your court practice.

Topics covered will include:

  • Developments in recent case law
  • Recent amendments to the Evidence Act
  • Examination of the operation of certain sections of the Act
  • Prior exculpatory statements
  • Section 44 notice requirements
  • Judicial directions as to relevance and use of certain evidence (s 35: HartWilson)
  • Common evidential issues in multi-defendant trials, including:
    – Text and voice identification (Hohepa)
    – Admissibility and reliability of co-conspirator statements
    – Undercover evidence
    – Judicial direction under s 126.
