Online CPD Module

Presentation time: 120 minutes

The law of torts continues to evolve at a fast pace and it is important that you are up-to-date as possible. This practical seminar will focus on the most important recent cases and what those cases mean for your clients’ cases, and how you can better argue those cases on their behalf.

This module will consider recent court decisions and legislative changes in a practical way. It will cover the following areas of tort law:

  • What is happening in the world of torts including a brief practical review of the theory that is driving recent cases
  • Building cases and their significance for the law of torts in general
    - Limitation of actions, under the old law and the new
    - Contributory negligence and what it means to have caused your own loss
  • Contribution
  • Defamation, the Internet and harmful communications
  • Nuisance
  • Trespass, assault and battery
  • Solicitor’s negligence
  • Torts and litigation and the reality of litigation, including contingency fees and litigation funding.

In addition to reviewing recent New Zealand developments the presenters will consider decisions from other common law jurisdictions such as Australia and the United Kingdom, which will influence the way that New Zealand will decide cases.

  • Acquire sound up-to-date knowledge of recent developments in the law of torts.
  • Gain understanding of the practical consequences of those developments.
