When a Family Court decision doesn’t go a client’s way, it’s the lawyer’s job to be able to guide them through their options, to identify whether there are grounds to appeal and know how the appeal process works.
Clearly, not all court decisions will be amenable to appeal. It will require a thoughtful analysis to consider whether, if jurisdiction exists to appeal, there are grounds to appeal. Not all errors will justify the High Court’s intervention.
This paper aims to provide a practical guide to the High Court appeal process so that we can respond promptly and effectively when an appeal issue is raised and advance our client’s case with confidence.
