Lawyers are now familiar with mediation as an alternative process to the litigation pathway. But is it really an alternative or just litigation in another guise? How does your role as an advocate respond to the mediation environment? This session will focus on how to maximise the benefits of the mediation pathway, how to get the solution your clients want, will discuss how to manage the role of experts and suggest strategies for negotiating in a highly charged environment.

This session outlines the findings of a qualitative research study using interviews with fathers to examine their experience of the legal processes used to determine care arrangements after separation. It will explore the main themes that emerged, focusing on: the severe grief reaction experienced by fathers following divorce/separation, the devaluation of fatherhood in Western societies, and fathers’ experiences of bias and powerlessness in family dispute resolution mediation and the Family Court, all viewed against the current socio-political backdrop of gender power struggles within the modern family.
