Introduction

The last year has seen some significant developments in health and safety law, with some significant liability decisions in areas such as officer’s duties and duties of PCBUs who manage or control a workplace. Sentencing under the Health and Safety at Work Act 2015 (HSWA) continues to develop.

Changes to health and safety law by way of amendments to the HSWA and regulations under the HSWA have also been announced by the Minister of Workplace Relations and Safety, Hon Brooke van Velden. While the detail of these changes is yet to be seen, they will have a major impact on obligations under the HSWA and on the operation of the regulators, including WorkSafe New Zealand (WorkSafe).
