The New Zealand Government has, in response to the COVID-19 epidemic, issued notices under the Epidemic Preparedness Act 2006, the Heath Act 1956 and the Civil Defence Emergency Management Act 2002. 1.1 This paper has been prepared under urgency to assist practitioners in addressing the issues which arise for commercial Landlords and Tenants out of the COVID-19 pandemic and the Government response to it – in particular, the key measures of the lockdown.
1.2 It is obviously an evolving situation and so this paper is necessarily brief, and as much as anything is intended to act as a resource kit for practitioners advising their clients on these issues.1.3 Schedules to this paper include extracts from standard form leases and copies of relevant orders and notices issued by the Government.
