World-wide demand for surrogate children from commissioning parents has recently grown. But there is no international legal regulation relating to issues of legal and moral acceptability of the commercialisation of the surrogacy process. Consequently intending parents (and their lawyers) are subject to differing ad hoc, complex and confusing regulations and policies.

This module will consider approaches to international surrogacy in six countries, with a focus on regulation, methods of determining legal parentage, commercial surrogacy and the impact of each country’s approach on whether it is seen as a “hub” of procreative tourism.

It also examines the current New Zealand stance and argues the need for new domestic legislation and an international legal framework designed specifically for the protection of the legal rights of children born of international surrogacy.

First presented and very well received at the International Adoption and Surrogacy Conference in April 2014, this r is a must for all family lawyers.
