Presentation time: 90 minutes

The new discovery rules came into effect in February 2012 and substantially modernised the way that discovery is undertaken in the High Court. Similar procedures now apply under the District Courts Rules 2014.

This module will provide a general overview of the discovery rules. It will have a practical focus in helping practitioners to understand the key principles and strategies to employ in dealing with the disclosure of documents in the current environment. It will be of benefit to all civil practitioners.

You will consider

  • Pre-commencement discovery
  • Initial disclosure
  • General discovery obligations
  • Tailored discovery
  • Particular and non-party discovery
  • Electronic discovery issues.

Learning objectives

You will gain the skills necessary to understand the Discovery Rules and operate effectively in the environment.
