This session will focus on the Criminal Procedure (Mentally Impaired Persons) Act 2003 CP(MIP) for Youth Advocates. Steve will discuss some fundamentals of the CP(MIP) Act as well as recent updates in case law and options to advocate for your young clients.

Topics will include:

  • Basic CP(MIP) process for young defendants
  • Remand and detention of young defendants undergoing inquiries under the CP(MIP) Act
  • Disposition options for young persons (fit and unfit) in the Youth Court under the CP(MIP) Act
  • Recent case law (Supreme Court and High Court) that affects the Youth Court CP(MIP) Act process
  • Stretching concepts of mental impairment and fitness to stand trial – clinical and legal challenges to the traditional CP(MIP) Act framework.

Learning objectives

By attending this seminar you will:

  • Gain an understanding of how to support the rights and needs of young defendants with mental impairments going through the Youth Justice process, with a focus on the CP(MIP) Act 2003 process.
  • Gain an increased awareness of the issues facing young defendants particularly regarding fitness to stand trial and disposition options under the CP(MIP) Act 2003.

Luke Cunningham Clere, Auckland

Steve is a partner at Luke Cunningham Clere and is an experienced civil and criminal litigator with particular expertise in criminal prosecution, regulatory enforcement litigation, and public law. In addition to prosecuting serious crime, he advises and represents government departments and regulatory bodies including Oranga Tamariki | Ministry for Children, and the Ministry of Social Development (Disability Support Services). He has been involved in Youth Justice work for nearly a decade, with a particular focus on litigation involving compulsory care orders and the Intellectual Disability (Compulsory Care and Rehabilitation) Act 2003.
