This paper will focus on principles of the Family Protection Act 1955 (FPA) and fiduciary duties/relationships and whether these do or ought to “stay in their own lane”, or how the two may interact or inform one another. To date, these aren’t often concepts put together. The case we’re going to focus on for the bulk of this webinar was heard by the Supreme Court in June 2023 and we’re waiting for their judgment with great interest.
