Introduction

The Public Works Act 1981 (PWA) and its processes can be invariably complex, confusing, and often highly stressful for an affected landowner. In putting these materials together, we have focused on providing a practical guide to assisting landowners affected by the PWA. I am able to do this having worked on both sides of the fence in the PWA space.

My experience includes time as an in-house counsel for an accredited supplier where I advised a nationwide team of specialist property consultants and negotiators who were assisting the Crown and local authorities acquiring and disposing of land required for public works. More recently, I have been acting exclusively for landowners affected by the PWA. I will set out the role of the accredited supplier later in this paper.

I intend for this session to provide an overview of the PWA acquisition and compensation process, practical considerations to effectively assist landowners and work well with the Crown, local authorities and their accredited suppliers, recent case law updates and some comments on the proposed law reforms.
