The Protection of Personal and Property Rights Act 1988 (PPPR Act) provides authority to the court to promote and protect people and under s 55 of this legislation an authorised property manager can make an application to the court to execute a will on behalf of a protected person. This webinar will take a practical approach and will include consideration of when a s 55 will should be contemplated, the entry level jurisdiction and legal tests, the drafting exercise, the potential inclusion of charities and what the application needs to cover. It will conclude with insights into the management of s 55 applications.

Theresa Donnelly Perpetual Guardian, Auckland Theresa has a wealth of experience in elder law and trust and estate-related matters. She was formerly at Public Trust (senior solicitor and team leader) and the Ministry of Social Development where she was lead senior in the public law team, working with Parliamentary Counsel, older people’s policy and the Office of Senior Citizens. Theresa worked on the 2017 changes to the EPA forms and has in-depth knowledge of the PPPR Act from a number of perspectives. She is a regular presenter to professional groups and is known for her practical approach to thorny issues. |
You may cancel your registration eight working days in advance of an event, and you will receive a refund less a 25% administration fee. If you cancel less than eight working days in advance of the event, no refund is payable. If you are unable to attend, you may transfer your registration to another person. If you wish to do so you must advise CLE New Zealand Law Society in writing of the change. CLE reserves the right to close registrations, and cancel or reschedule an event as necessary. Where an event is cancelled by CLE, a full refund is payable.
