This seminar offers an in-depth look at the two primary legal avenues for pursuing a discrimination claim: the Human Rights Review Tribunal and the Employment Relations Authority/Court. Presented by the Chief Judge of the Employment Court and the Chairperson of the Human Rights Review Tribunal, with commentary and facilitation by an experienced employment and human rights lawyer, the session will demystify the procedural and strategic aspects of each forum.

Topics covered will include:

  • The practical process of how each jurisdiction operates
  • Jurisdictional thresholds and the pros and cons of each route
  • A discussion about the remedies available
  • The legal framework underpinning/underlying each jurisdiction
  • Consideration of the factors that influence strategic decision-making when choosing where to bring a discrimination claim
  • How to effectively advise clients, including timelines, evidence, and remedies.

Chief Employment Court Judge, Wellington

Prior to being sworn in as an Employment Court Judge in 2011, Chief Judge Inglis led the Human Rights team at Crown Law. She was formerly on the Advisory Board of the New Zealand Centre for Human Rights Law, Policy and Practice; is a member of the Board of the Access to Justice Advisory Group; was Chair of Te Awa Tuia Tangata (the Heads of Bench judicial diversity committee); and is a member of the Heads of Bench Future Courts Steering Group. In 2023 Chief Judge Inglis was awarded an honorary doctorate by Te Herenga Waka ǀ Victoria University in recognition of her contribution to the law.

Human Rights Review Tribunal ǀ Taraipiunara Mana Tangata, New Zealand

Sarah was appointed Chairperson of the Tribunal in 2022 and prior to that was a Deputy Chairperson. She has been a lawyer for almost 25 years, with 15 years of experience across a range of tribunal jurisdictions. Sarah’s tribunal work has included the Disputes Tribunal, the Human Rights Review Tribunal, working as a Visiting Justice in prisons and determining refugee claims.

AJ co-leads Anderson Lloyd’s employment team, providing pragmatic solutions to complex workplace issues. Her experience covers the full range of employment challenges, human rights, privacy and health and safety matters. AJ is a certified Association of Workplace Investigators member and Certificate Holder (AWI-CH), and experienced in investigating allegations of sexual harassment, bullying, and matters involving vulnerable people.

Cancellation and refund policy

You may cancel your registration eight working days in advance of an event, and you will receive a refund less a 25% administration fee. If you cancel less than eight working days in advance of the event, no refund is payable. If you are unable to attend, you may transfer your registration to another person. If you wish to do so you must advise CLE New Zealand Law Society in writing of the change. CLE reserves the right to close registrations, and cancel or reschedule an event as necessary. Where an event is cancelled by CLE, a full refund is payable.
