At the request of many lawyers who have attended Professor Douglas Lind’s popular workshops on logic and legal reasoning in previous years, NZLS CLE is offering an advanced logic workshop. This workshop includes a refresher on the basic principles of inductive and deductive reasoning covered in the standard programme, but goes well beyond that workshop in argument detail and practical application.

If you are tantalised by how understanding logic and principles of argument enhances a lawyer’s skill in everyday legal practice, this workshop is for you. In addition to providing a practical framework for understanding legal arguments, the workshop emphasises the interplay between definition and inference – how different types of definition signal different forms of argument.

Throughout, the workshop will include active engagement by participants in case law analysis. Attend this workshop to hone your analytic legal skills and ability to work with legal arguments. Even if you have not attended Professor Lind’s standard workshop, this programme will benefit you. The pre-workshop reading assignment will well-prepare all lawyers for active participation in this programme.

This workshop will cover:

  • Workshop goals
  • Definition and inference
    – Paradoxes of definition
    – Patterns of reasoning and argument
    – Exploring the interplay between definition and argument
  • Forms and limits of inductive reasoning
    – Analogy and generalisation
    – Case law analysis
  • Categorical syllogisms
  • Structures of deductive reasoning
    – Deductive syllogisms.

Learning objectives

To help you:

  • Enhance your ability to understand the logic and forms of argument underlying legal reasoning.
  • Understand the interplay between definition and inference.
  • Develop skill in logical analysis of case law.

Format

The workshop will mix lecture, discussion, and case law analysis. It will emphasise practical understanding of those argument forms and fallacies most relevant to legal practice, and apply logical principles in case law analysis. Numbers are limited to 32 participants.

Materials

Some reading material will be sent to participants prior to the workshop. The course materials will be given to participants when they register on the day.

Cancellation and refund policy

Please note: Minimum and maximum numbers apply. Registrations will be accepted on a first-come/first-served basis. Registrations close 10 working days before the presentation date (the closing date). NZLS CLE Ltd reserves the right to cancel any session that does not reach the budgeted minimum number of registrations. This decision will be made on the closing date and a full refund will be made to each registrant of the cancelled session. If you cancel your registration before the closing date, a refund will be made, less a $100 administration fee. After the closing date, there will be no refund. You may transfer your registration until five working days before the presentation. Please advise NZLS CLE Ltd in writing of the change.
