The Overseas Investment (Urgent Measures) Amendment Act 2020 amends the Overseas Investment Act 2005 (the Act). The changes include a new “national interest” assessment, and a compulsory notification requirement for business transactions in which a controlling interest is being acquired, as a COVID-19 economic recovery measure, impacting a wider range of investors. The presenters will take a practical approach to help you identify where your clients’ activities are captured by the regime so that you are able to effectively provide them with robust advice.

The law changes are designed to balance the important role overseas investment will play in supporting New Zealand’s economic growth and recovery, while also seeking to ensure that this country’s interests are protected. This webinar will help you understand the implications of the changes.

Topics covered will include:

  • How investments covered by the Act can be made
  • What constitutes “sensitive assets”
  • A new “national interest” assessment
  • A temporary compulsory notification requirement when a controlling interest is acquired
  • How fewer low risk transactions will be screened
  • The stronger enforcement powers of the Overseas Investment Office.
