All residential property files are not equal. Some proceed very smoothly and others just go wrong. Potentially problematic signals are easily missed or overlooked.

This seminar will go through the three stages of the sale and purchase process; negotiation, contract and settlement covering topics aimed at preventing your property files becoming difficult and turning into a settlement day nightmare.

Various recent developments in issues relating to agreements for sale and purchase may effect a client’s position and play out in the longer term. These include: trustee’s signatures; breaches of warranty that have become apparent before settlement; the operation of warranties and how the court is approaching them; the consequences of damage to the premises; the operation of the cancellation process for non-settlement in a non-physical environment; the operation of exclusion clauses, and same day cleared payments (SCP).

In addition to the above other topical issues will be covered:

Changes to house insurance
Most policies now being offered are based on a maximum sum insured value. Calculating the sum insured value for properties can be complicated and controversial, especially in relation to professional services such as architects and legal costs.

Properties affected by Methamphetamine (P)
Property investors need to be aware of the danger of purchasing P damaged properties. Are vendors and landlords obliged to inform purchasers about P contamination? What steps should purchasers take to investigate properties before purchase?

It may sound overly simplistic or trite but effective communication is the only means of ensuring there are no preventable difficulties on settlement day. Hearing about issues and working out solutions early will undoubtedly mean settlement day will be less stressful. Even if settlement does not proceed as scheduled it will not be a surprise.

That communication starts with effective communication with clients. I appreciate not all clients are trainable, but those who are should be encouraged to contact you when they begin searching for a property to purchase.

(I will concentrate primarily on the purchase process not only because a sale must logically be preceded by a purchase but also because a sale is generally less complex. The comments applying to methods of sale will of course be part of a discussion with a client intending to sell and the section on disclosure later in this paper will also be important when advising vendors).
