The Family Dispute Resolution (FDR) service is a key element of the new Family Justice System (FJS) that started on 31 March. FDR is provided by mediators who have been appointed by one of three ADROs (Alternative Dispute Resolution Organisations). The NZLS is one such ADRO and must be satisfied that its appointees meet the competency requirements set out in FDR Reg 7.

Many of the competencies you will already have as a result of your current mediation training and practice, your Lawyer for the Child training and your family law experience. But some competencies will need developing. You also need to understand exactly how FDR fits into the FJS, what parties may or may not have done before they see you as an FDR mediator, and your options before commencing and in convening an FDR mediation.

Learning Objectives

You will:
  • Identify how parties may enter FDR and what assistance they may have received beforehand in dealing with their dispute.
  • Identify how your initial dealing with the parties will likely differ from what you have experienced to date in family mediations.
  • Identify strategies to ensure the voice of the child is heard and/or considered in the mediation.
  • Understand what is meant by initial and on-going risk assessment and how to discharge this responsibility.
  • Complete the mediation paperwork when agreement has been reached and when it has not.

  * Upon satisfactory completion of the Post Webinar Review Task, three CPD hours are available for this presentation.

Post Webinar Review Task

To obtain a certificate of completion and CPD verification, you will be required to submit answers to three written exercises (1100 words total). Download a copy of the Review Task.
