embarking on its largest vaccination rollout as COVID-19 vaccinations become increasingly available across the country, with those considered “high-risk” given priority at these early stages of the rollout. In the employment context, the availability of the vaccine has caused some practical issues for employers to consider.

This paper explores an employer’s obligations in relation to managing COVID-19 in the workplace. Whilst an employer cannot (in the absence of an Act of Parliament or other statutory instrument) require an employee to be vaccinated, in some situations it might be justifiable for an employer to require certain work to be carried out by vaccinated workers only. Employers will need to approach every unique situation with its obligations under the Employment Relations Act 2000 in mind, including its obligation to act in good faith and fairly and reasonably.
