Webinar Archive Presentation

Presentation time: 90 minutes

Costs are an issue which invariably confronts almost every civil litigator, and although they are considered in virtually every case, they continue to pose unexpected and, at times, difficult questions. This webinar will provide you with an overview of the general principles underpinning costs and also adopt a practical focus in considering some specific and recent issues in this area.

This webinar will include:

  • A brief overview of the general principles of costs in civil litigation
  • Guidance on applications for indemnity costs and for reduced costs
  • Consideration of the relevance of actual costs against scale costs (when indemnity costs are not payable)
  • Consideration of some of the practical implications when security for costs are required
  • An outline of Sanderson and Bullock orders; what these are and when they can be used
  • A brief discussion regarding enforcement of costs awards, particularly on interlocutory applications
  • Practical tips on applications for costs.

Please contact us if you use a dial up internet connection.

Introduction

Civil litigation contains few certainties. One, however, is that it is expensive. As relationships, both private and commercial, become more complex so, too, do the proceedings that ensue when the legal rights and obligations arising out of such relationships must be identified, applied and enforced. The single most expensive part of such proceedings is almost invariably legal fees. Naturally there are also what are called disbursements which are those fees or costs incurred in respect of matters such as filing documents in court, retaining agents to undertake research or serve documents and organise the multitudes of documents that are commonplace.

This seminar is concerned with the first of those, legal fees and the costs payable, in civil litigation, in respect of them.
