Introduction


Much of our work as lawyers and advisers is about helping our clients (whether employers or employees) avoid a personal grievance. Sometimes, however, despite your and your client’s efforts (or in some cases as a result of them) you will still be presented with a personal grievance claim.

The way in which a case is presented or dealt with will have a huge effect on the eventual outcome. Where a case is marginal the difference between good advocacy and bad advocacy, a well handled or prepared case and a badly handed and unprepared case can be the difference between winning or losing. The way in which a case is handled does not only impact on the outcome, it also has an effect on costs, the amount of time taken from beginning to end and the level of disruption to the workplace and individuals involved.

The purpose of this paper is to help you run a personal grievance case in a way that increases your chance of winning and minimises the negative impact on your client’s costs and time.
