Property subdivisions can entail a myriad of issues that need to be worked through and can prove to be a risky, exciting and potentially profitable venture for your clients. This module will take a practical approach to subdivisions from the viewpoint of the suburban developer and working effectively and efficiently with local government to give effect to consents.

This module will include:

  • A practical guide to the subdivision process with steps to follow to ease the process when acting for developers and to assist the interface with local government, including:
    • initial due diligence/title investigations
    • discussion of the different types of subdivisions and applicable requirements
    • review of Part 10 of the Resource Management Act 1991 (RMA) and the requirements on both the local government and land owners
    • reviewing resource and subdivision consents, including local government conditions and statutory timeframes for release of s 223 and s 224 certificates under the RMA
    • reading LT Plans and Unit Plans, and associated schedules showing required instruments for registration
  • Preparation for and deposit of subdivision plans and the registration of titles, including:
    • obtaining approved local government documentation, such as consent notices, easements, covenants, bonds
    • general e-dealing procedure and obtaining consents from interested parties.

Introduction

This seminar is aimed at junior to intermediate property lawyers with the intention of
providing an outline of the subdivision process, including practical steps for subdivision
procedures and emphasising the importance of early and continued engagement with the
client, surveyor and Council officers. Appendix 1 sets out the general subdivision steps,
which this seminar will follow and elaborate on. As lawyers, we can have an impact on our
clients’ profits and this seminar is designed to assist you to understand the steps involved
in the subdivision process to improve your delivery to clients.
