Gifting - giving it all away? - 1.5 CPD hours

  • Publication date: May 2016
  • Authors: Chris Kelly, Greg Kelly

Increasingly gifting structures and documents need to be tailored to the needs of individual clients. When gifting duty was abolished in 2011 the legislation did more than just simplify the tax system. Accepted gifting arrangements and practices, which had been used for generations, began to be called into question.

The nature and scope of gifting, and the lawyer’s role in advising, varies from one client to another. A thorough understanding the “why” and “how” of gifting in this changing environment will help you to resolve possible problems that may arise further down the track.

This module will discuss potential complications, the key issues to be aware of and documentation best practice. It will consider the different solutions, along with the specific tools available to practitioners when advising clients about gifting.

Topics covered will include:
  • Gifting versus a loan, helping your client to clarify their intention
  • Presumption of advancement and the intention to make a gift
  • Capacity to make a gift, possible issues to be alert to
  • Documentation best practice.

Trustees - meeting obligations & minimising risk - 2 CPD hours

  • Publication date: November 2014
  • Authors: Helen Dervan, Jeremy Johnson

Lawyers traditionally assume office as trustees for private clients and for charities. However, the job is not as simple as it used to be and trustees are increasingly exposed to legal risk – from beneficiaries and from third parties. As professional trustees, and professional advisors, lawyers are increasingly expected to provide the answers in difficult situations.

This seminar will discuss the role of the trustee with a focus on explaining how to fulfil the role and meet obligations while minimising the inherent risks, particularly for professional trustees.

There will be an analysis of:
  • The duties that trustees owe to beneficiaries and the nature of trustee obligations to third parties with a particular emphasis on recent cases and refinements in the law.
  • An examination of strategies that trustees can employ to minimise the risks they face when performing the role and the best way to avoid or minimise liability; and
  • Suggestions will be made as to the use of alternative dispute resolution methods in situations of dispute.
