Health and Safety Update 2020 - 1.5 CPD hours

  • Publication date: April 2020
  • Authors: Greg Cain, Michael Hargreaves

COVID-19 presents major risks to many clients’ businesses and to their people – workers, customers, suppliers and others. Practitioners need to understand the legal issues presented by the virus, and the regulator’s views on what clients need to do.

Understanding WorkSafe’s enforcement strategy is also critical for practitioners advising clients on health and safety issues, as is a good grasp of the alternative sentencing options and related case law trends.

This module will outline WorkSafe’s approach to enforcement and regulatory settings, provide an update of the key cases, especially on alternative sentencing options, and will explore the employment and health and safety issues presented by COVID-19.

Topics covered will include:

  • WorkSafe’s enforcement strategy
  • First reckless conduct case
  • Current enforcement issues – particularly alternative sentencing options
  • COVID-19 – what are the employment law and health and safety issues, and what’s the view of the regulator?

Gifting Update 2020 - 1.5 CPD hours

  • Publication date: April 2020
  • Authors: Chris Kelly, Greg Kelly

Gifting arrangements and documentation need to reflect the changing legal and regulatory environment and individual client’s circumstances. It is no longer appropriate to use standard sale and purchase, debt back and forgiveness of debt arrangements. There is no longer one standard or right approach: gifting documents need to be adapted to individual circumstances.

The nature and scope of gifting, and the lawyer’s role in advising, varies from one client to another. A thorough understanding of the “why” and “how” of gifting in this changing environment will help you to resolve possible problems.

This module will discuss potential complications, the key issues to be aware of, and documentation best practice. It will consider the different solutions, along with the specific tools available to lawyers when advising your client about gifting.

Topics covered will include:

  • Gifting versus a loan, helping your client to clarify which is which
  • Presumption of advancement and the intention to make a gift
  • Capacity to make a gift, the signs to be aware of
  • Documentation best practice
  • Consequences of no documentation.

Speaking Your Clients' Language - 1.5 CPD hours

  • Publication date: March 2018
  • Author: Brenda Ratcliff

Many lawyers say that the purpose of communication is to encourage clients, juries, bosses, and direct reports to act in a certain way. Why is it that many of us are left wondering why our clear advice does not motivate others, when it is clearly the right thing to do? Why are we tongue-tied when travelling four floors in the elevator with our boss? The answers to these two questions lie in understanding the motivation of your audience. When you match your language to what motivates others, then you can achieve a winning combination.

This module will enable you to think on your feet by helping you to understand common forms of motivation, and how to match your language to these common forms. This will help you be more articulate, influential, and enable you to avoid conversational de-railers which block action on your message.

This is a fresh way to think about motivation so that you can make your point in a way that resonates with your audience whoever they are.

Topics covered will include:

  • Why thinking about motivation is important
  • Creating emotional meaning leads to motivation, which leads to action
  • How others see the world
  • A new tool for speaking to client’s motivations
  • The importance of getting “the nod”.

Employment Fundamentals - managing the relationship 2019 - 1.5 CPD hours

  • Publication date: June 2019
  • Authors: Bridget Smith, Andrea Twaddle

At the heart of the employment relationship is the principle of good faith, with employees and employers obliged to deal with each other fairly and reasonably at all times.

It is imperative that you are able to provide your clients with timely and effective advice in the employment arena. Relatively small issues, that are not effectively addressed from the outset, can rapidly escalate and morph into much larger problems for your clients.

This module will consider key aspects of the employment relationship including good faith, changing terms, disciplinary action and performance management.

In considering these aspects, it will examine the practical implications of s 103A and s 4 of the Employment Relations Act 2000. Section 103A sets out a test for determining whether an employer’s actions were that of a fair and reasonable employer in the circumstances.

Advice to ensure a fair process will be covered from the perspectives of the employer and employee.

Additionally, it will look at, in what circumstances it would be advisable to recommend that the client engage the services of an independent investigator.
