Franchising remains a growth industry in New Zealand that is becoming increasingly complex and specialised and it is important that practitioners are able to provide their clients with effective advice on potentially life changing decisions. This seminar will cover the fundamentals of advising your clients on entry into a franchise agreement and working through some of the common disputes that may emerge both in the course of the relationship and on termination.

This seminar will include:

  • Introduction to the business format franchise model as a way of owning a business
  • Advising prospective franchisees on the implications of signing a Franchise Agreement
  • Comment on how Health and Safety in Employment, Competition and Employment laws impact on content and performance of Franchise Agreements
  • When franchising goes bad and how to deal with common disputes that arising in franchising
  • What to do when the franchisor does not perform
  • Update on enforceability of restraints of trade in franchising
  • What does lack of good faith look like in the franchise context?

Learning objectives

After attending this seminar you will be able to:

  • More confidently advise clients contemplating starting or purchasing a franchise business.
  • Know what look for when reviewing a Franchise Agreement and how to usefully summarise client risks and options.
  • Have an up to date knowledge of how the courts may deal with franchise disputes, breaches and restraints.
  • Understand how to secure the best deal for a franchisee client who wants to exit their franchise and understand the “how not to” methods of resolving franchise disputes.
