Lawyers in New Zealand are frequently personally trustees of family trusts, directors and/or shareholders of trustee companies, or advising trustees of family trusts. For the legal profession to do the best for its clients, there needs to be a focus on best practice in trust administration.

This module discusses the importance of carefully managing the way trusts are administered, providing as much practical guidance as possible for trust lawyers, to help avoid liability and provide best practice for clients.

Trusts are prevalent in New Zealand but there may be some poor administration. There are more disputes and litigation involving trusts which increases the need for good administration.

This module will address good and best practice in trust administration, key moments and transition points, in the life of a trust.

Topics covered will include:

  • Creation of trusts and becoming a trustee
  • Administration of the trust including the set-up of the administrative process
  • “Due diligence” on appointment
  • Resettlement of the trust
  • Changing of the guard
  • Termination of the trust.

There are a number of transition points in the life of a trust and this paper considers the practical aspects that arise in relation to the following transition points:
