Section 44 of the Property (Relationships) Act 1976 (PRA) is an increasingly effective tool to claw back property that would otherwise have become relationship property, had it not been disposed of to a trust. The development of the legal principles since Coles v Coles has culminated in the most recent decision of the Supreme Court in Sutton v Bell. This webinar examines the Supreme Court’s definitive approval of Regal Castings Ltd v Lightbody in the relationship property context, as well as the timing of dispositions and the court’s sanctioning of the legitimate means of protecting property – contracting out under s 21 PRA.
