This webinar will cover the scope of the following vendor warranties:
- The vendor’s warranties in cl 7 of the ADLS Agreement for Sale and Purchase of Real Estate (ninth edition 2012(8)) including warranties relating to:
- Notices of outstanding requisitions or requirements
- Chattels, plant and equipment
- The Vendor obtaining consents for work done on the property and complying with those consents
- The Vendor giving consents or waivers affecting the property
- Building Act compliance
- Breach of any warranty not deferring the obligation to settle.
- The warranties in:
- Clause 14.3 – The Vendor’s GST warranty regarding the dwelling and curtilage
- Clause 15.0 – The Vendor’s GST status and the completion of Schedule 1 – GST information
- Clause 16.0 – Supply of a going concern.
