Phase 2 of the AML/CFT Act extends the regime, to include lawyers and conveyancers, accountants, and real estate agents and high-value dealers. Lawyers and conveyancers must be compliant with their AML/CFT Act obligations by 1 July 2018.

This presents both conceptual and practical challenges for the profession, and much work will need to be done by affected lawyers prior to that date. This series will help ensure that you have a practical understanding of the steps that you need to take in order to comply with the legislation.

Webinar 1 - Compliance Programmes

The webinar will reflect the need for each firm to establish whether it is within the purview of the AML/CFT Act, and the practical steps:
  • The meaning of “ordinary course of business”
  • The appointment of an AML Compliance Officer
  • Risk Assessments drafting and content
  • Designated Business Groups
  • Establishing a compliance programme, including audits.

The presenters will make a recommendation for a suitable compliance structure for medium sized firms, taking into account the Department of Internal Affairs Guidance Notes and will discuss third party engagements and Prescribed Transaction Reports.

Webinar 2 - Due Diligence

A full understanding of your clients and the nature of their activities and associated transactions is at the cornerstone of the AML/CFT legislation. However, it may also mean that you are able to identify further opportunities to meet their legal needs.

This webinar will have a strong focus on client due diligence processes, particularly enhanced customer due diligence, provide advice in respect of assessing client activity and preparing and filing Suspicious Activity Reports, and outline the applicable penalties for non-compliance.

The presenters will consider common practice scenarios such as client referrals, foreign law firms, and special situations such as receiverships.

After this webinar you will have:
  • A greater understanding of the different due diligence processes required.
  • An understanding of the penalties for non-compliance.
