The presumption of competence is a fundamental cornerstone of our legal system. Ensuring our clients have the capacity to enter into legal relationships is an essential task for legal practitioners, whether those be contracts, marriage, wills or powers of attorney. This starts with confirming that the client is able to give us instructions. As our clients age and progressive incapacity becomes more prevalent, questions as to what is best practice are becoming more commonplace. This forum aims to review the current legal and medical thinking around capacity and to provide practical input into this challenging area which affects all practitioners. We look forward to furthering your understanding in this area and to some lively discussions during the forum, informed by presenters from the judiciary, academia, lawyers and doctors.Chair: Kathryn Lellman
