From the Chair

The presumption of competence is a fundamental cornerstone of our legal system. Ensuring our clients have the capacity to enter into legal relationships is an essential task for legal practitioners, whether those be contracts, marriage, wills or powers of attorney. This starts with confirming that the client is able to give us instructions. As our clients age and progressive incapacity becomes more prevalent, questions as to what is best practice are becoming more commonplace. This forum aims to review the current legal and medical thinking around capacity and to provide practical input into this challenging area which affects all practitioners. We look forward to furthering your understanding in this area and to some lively discussions during the forum, informed by presenters from the judiciary, academia, lawyers and doctors.

Learning objectives

By attending this forum you will:

  • Deepen your appreciation of the necessary mental capacity for different legal transactions.
  • Upgrade your skills for requesting capacity assessments.

Who should attend

All lawyers who want to ensure they comply with best practice relating to the mental capacity of every client in all transactions. The forum will be of special interest to those working with PPPR Act cases, and family or civil litigators.

Please note: Places for in-person attendance are limited so register early to avoid disappointment.

Format

By combining formal presentations with panel discussions, along with case studies for your own analysis, this forum will give you an interactive day of learning.

To give life to this very important topic we are trying a new concept: holding the forum at the NZLS Auckland Branch with a limited in-person audience, while welcoming a live web stream audience from all over New Zealand. This will create a unique opportunity for everyone to be part of this important dialogue.

Cancellation and refund policy

Please note: Minimum and maximum numbers apply. Registrations will be accepted on a first-come/first-served basis. Registrations close 10 working days before the presentation date (the closing date). NZLS CLE Ltd reserves the right to cancel any session that does not reach the budgeted minimum number of registrations. This decision will be made on the closing date and a full refund will be made to each registrant of the cancelled session. If you cancel your registration before the closing date, a refund will be made, less a $100 administration fee. After the closing date, there will be no refund. You may transfer your registration to another person until five working days before the presentation. Please advise NZLS CLE Ltd in writing of the change.
