In terms of effective dispute resolution, going to court is costly, the process can take years, and returns can be less than what was put in. Done well, arbitration offers an efficient alternative route to a binding and enforceable outcome – not just for large commercial cases, but for civil disputes of all kinds. This seminar looks at the ways in which arbitration can be put to work in resolving everyday civil disputes.

This seminar will include:

  • What arbitration is and why it is not mediation
  • Why arbitrate
  • What to do, what to think about, pitfalls and avoiding the danger
  • What resources are available
  • What to do once you have an award.

Learning objectives

By attending this seminar you will be able to:

  • Evaluate the advantages of arbitration and advise clients appropriately.
  • Confidently initiate arbitration and secure the appointment of an Arbitrator.
  • Gain an understanding of arbitration procedure, so that you can represent your client effectively.
  • Understand the practicalities of challenging or enforcing an award.

Mark is a Barrister and Arbitrator at FortyEight Shortland Barristers, Auckland. He has over 25 years’ experience advising and representing clients in significant civil and commercial disputes. Mark has a particular focus and expertise in the construction, infrastructure and property sectors. Mark is a leading arbitration practitioner. He is a Fellow of the Chartered Institute of Arbitrators (UK), and is an arbitration panel member of a number of arbitral institutions, including the New Zealand Dispute Resolution Centre. Mark’s experience includes ad hoc arbitration, and arbitration under various institutional rules. In 2019 Mark was appointed to the Panel of Arbitrators of the New Zealand Law Society. Amongst other roles, he is the current convenor of the ADLS Property Disputes Committee, Member of the Society of Construction Law, and is a former Council Member of the Arbitrators’ & Meditators’ Institute of New Zealand.

Anna is a commercial arbitrator, adjudicator and barrister at Bankside Chambers, with particular expertise in international arbitration and public international law. She spent a number of years working in international arbitration in London and has more recently worked closely with Sir David Williams QC. Anna is a contributing author to Williams & Kawharu on Arbitration, teaches international arbitration at the University of Auckland and holds a PhD in international law from the University of Cambridge. She is a Fellow and Council Member of the Arbitrators’ and Mediators’ Institute of New Zealand (AMINZ) and a Fellow of the Chartered Institute of Arbitrators (UK). Anna also sits on a number of arbitral panels, including AMINZ, the New Zealand Dispute Resolution Centre and the Singapore International Arbitration Centre (reserve panel).

Cancellation and refund policy

If written notice of cancellation of a registration arrives before the day of the seminar we will refund the registration fee, less an administration fee of $40. If you are unable to attend, you may send a substitute - to correctly assign CPD credit, CLE must be notified in advance. NZLS CLE Ltd reserves the right to cancel or reschedule seminars if necessary.
