Negligence claims are a potential risk for all practitioners. This seminar will update you on the latest developments in this important area. Following on from a session at the Wellington CPD Top Up Day in February 2017, it will consider the key solicitor negligence cases that have been through the domestic appellate courts over the last two years. It will also touch on some overseas cases by way of contrasting examples.

The seminar will focus on the topical issues emerging from the latest case law, and offer some guidance to practitioners about practical steps that can be taken to avoid being caught in a solicitor negligence claim.

Tiho has developed an interest in the law of lawyers’ professional responsibilities through his experience as an advocate appearing in tribunals and courts in New Zealand including at all courts of first instance and appeal. His perspective comes from conducting litigation in a wide variety of legal disputes including in respect of public law and judicial review, company disputes, environmental cases and regulatory and disciplinary and criminal matters. Tiho has acted for and against firms of solicitors and other professionals in respect of negligence. He has also lectured in legal ethics at Victoria University of Wellington.

Esther specialises in commercial, regulatory and public law litigation. She is an experienced advocate and has appeared in complex commercial cases in New Zealand and overseas. Prior to joining the independent bar, Esther practised litigation at leading solicitors’ firms in New Zealand and London.

Esther’s relevant recent experience includes acting for solicitors in respect of claims alleging negligence and breach of fiduciary duty and advising insurers in respect of professional indemnity claims by solicitors.

Cancellation and refund policy

If written notice of cancellation of a registration arrives before the day of the seminar we will refund the registration fee, less an administration fee of $40. If you are unable to attend, you may send a substitute - to correctly assign CPD credit, CLE must be notified in advance.
