Case law can have a large impact on the considerations that you need to give to drafting and negotiating the terms of a commercial lease. Often you will be aware of a recent decision but unsure of the practical implications. This seminar will review some recent cases and discuss their applicability, including points to consider when drafting or negotiating lease terms. It will provide practical advice on pre-contract negotiations, repair and reinstatement, rent review, destruction and untenantability (with particular focus on earthquakes and insurance), rent, renewal, assignment, indemnities and termination/cancellation. Some helpful tips on variations and registered leases will also be provided.
