This seminar addresses the “good, the bad and the ugly” of trusts within a commercial context. It will canvass fundamental issues and consider some of the key decisions emerging from the case law and the implications for practitioners on a practical level.

This seminar will include:
  • Consideration of the advantages and disadvantages of trusts compared with other arrangements
  • How the new Trusts Act will affect your clients and your advice to them
  • Issues to be aware of when dealing with trusts including relevant provisions in trust deeds, best practice, documentation, trustees’ liability and indemnity, etc
  • An update on current case law.

Learning objectives

By attending this seminar you will gain:

  • Increased knowledge on the relevant issues to consider in determining if a trust or some other vehicle is the appropriate vehicle for a particular situation or transaction.
  • Skills to identify issues that clients should be aware of when dealing with trusts (either where practitioners are acting for trusts or in situations where the other parties include trusts).

Stephen is a graduate of Victoria University of Wellington and was admitted in 1996. As a senior associate with TGT Legal, he advises on trusts, estates and succession planning. Stephen also has a background in advising on a wide range of company and commercial law matters.

Partner, TGT Legal, Auckland

Juliet is a partner at TGT Legal, a boutique trust and private client law firm based in Auckland. She specialises in trusts, personal asset planning and superannuation and is a regular presenter of seminars and author of articles on issues arising in those areas. Juliet has spoken at previous NZLS Trusts conferences, ADLS conferences, and at STEP (Society of Trust and Estate Practitioners) and Chartered Accountants Australia & New Zealand events. She is the chair of the STEP education committee and also published a chapter in the CCH 2011 edition of the Master Trusts Guide on the Termination and Insolvency of Trusts.
