Errors in dealing with GST on property transactions are very common, and mistakes can be expensive and difficult to fix. Compulsory zero-rating of land has shifted the GST risk on land transactions away from Inland Revenue to the transacting parties. Several land GST cases (some involving Inland Revenue, some just between vendors and purchasers) have gone to court and many more are settled out of court. This seminar will adopt a practical focus in examining key potential pitfalls to avoid to help you mitigate against issues arising, and outlining steps that you can take to help protect your clients.

This seminar will include:
  • An overview of fundamental GST concepts
  • Discussion of the core concept of a “taxable activity”
  • Outline of the land compulsory zero-rating rules (CZR)
  • Discussion of tension points and traps to avoid
  • Case study analysis of YL NZ Investment Ltd v Ling and its practical consequences
  • Real-world examples demonstrating common issues
  • Best practice checklists
  • Overview of zero-rating of legal services to non-residents connected with land.
