There are many factors that lawyers need to be mindful of when considering their own professional indemnity insurance arrangements or when advising clients about professional indemnity claims and policy response. This seminar will consider some of the key issues facing insured professionals and recent developments of interest.

This seminar will include:
  • An overview of a professional indemnity claim
  • Discussion of the obligations of the insured under the policy, particularly notification of circumstances
  • Discussion of common policy response issues
  • Recent case law developments
  • Practical tips for working with an insurer or broker to minimise risk of a claim or mitigate loss under a claim.

  • Greater awareness of how professional indemnity policies work, the insured's obligations and how to avoid prejudicing cover.
  • Practical tips for you/your clients in dealing with a professional indemnity claim.

Andrea has been a partner at McElroys since 2000, and in practice for 25 years. She is regularly instructed by insurers to provide indemnity advice and represent their insured clients in many different fields, including professional indemnity work. Andrea has represented insurers in numerous indemnity disputes recently before the Courts including Fund Managers Canterbury Ltd v AIG Insurance New Zealand, Zurich Australian Insurance v Withers, and Hanover Group Holdings Ltd v AIG Insurance New Zealand Ltd.

Kiri has been a partner at McElroys since 2015, and in practice for 14 years. In her professional indemnity practice, Kiri advises insurers on policy response and defends professionals against liability claims. Recently, Kiri acted for the insurers in Zurich Australian Insurance v Withers and Warrington v AIG Insurance Ltd, and defended professionals in P v F, Macalister Mazengarb v Annan Law and Southland Indoor Leisure Centre Charitable Trust v Invercargill City Council.

If you are unable to attend, you may send a substitute - to correctly assign CPD credit, CLE must be notified in advance.
